DISABILITY RETIREMENT ATTORNEY / LAWYER

Qualified federal employees under both the Federal Employee Retirement System (FERS) and the Civil Service Retirement System (CSRS) are entitled to apply for disability retirement benefits from the federal government. At Flook & Graham, P.C., we can assist you in navigating the often difficult and confusing process of applying for these benefits. We have over 15 years of experience in handling these claims and can represent you in each stage of the process, including the initial application, working with the Office of Personnel Management (OPM) and, if necessary, appealing your claim to the Merit Systems Protection Board (MSPB). In order to qualify for a disability retirement annuity, a federal employee must meet several requirements, including: |

|
| Completion of 18 months of credible service (for FERS employees) | ||
| Completion of 5 years of credible service (for CSRS employees) | ||
| Have a disease or illness which: | ||
- Is expected to last at least one year,
- Prohibits the employee from rendering useful and efficient service in his or her position, and
- Prohibits the Agency from accommodating or reassigning the employee
Please keep in mind that your application must be received by OPM within 1 year
of your separation from service. Additionally, your obligation to file for these benefits is
not met if and when you file for benefits under the Social Security Administration's
disability application process. While similar in some ways, your claim for Social Security benefits is distinct and separate from your available benefits as a federal employee. It is often the case that it is in your best interests to pursue both of these claims for disability retirement benefits.
As an employee (or former employee) of the federal government, you may be entitled to receive disability retirement benefits. We at Flook & Graham, P.C. are experienced in this area of the law and welcome the opportunity to discuss your particular situation with you and explore your options.
